  1. In addition, if Recipient institutes patent litigation against any entity (including a cross-claim or counterclaim in a lawsuit) alleging that the Program itself (excluding combinations of the Program with other software or hardware) infringes such Recipient’s patent(s), then such Recipient’s rights granted under Section 2(b) shall terminate as of the date such litigation is filed.

5.2. If You initiate litigation against any entity by asserting a patent infringement claim (excluding declaratory judgment actions, counter-claims, and cross-claims) alleging that a Contributor Version directly or indirectly infringes any patent, then the rights granted to You by any and all Contributors for the Covered Software under Section 2.1 of this License shall terminate.

The license granted hereunder will terminate, automatically and without notice, for anyone that makes any claim (including by filing any lawsuit, assertion or other action) alleging

(a) direct, indirect, or contributory infringement or inducement to infringe any patent:

(i) by Facebook or any of its subsidiaries or affiliates, whether or not such claim is related to the Software,

(ii) by any party if such claim arises in whole or in part from any software, product or service of Facebook or any of its subsidiaries or affiliates, whether or not such claim is related to the Software, or

(iii) by any party relating to the Software; or

(b) that any right in any patent claim of Facebook is invalid or unenforceable.

React PATENTS Revised

The license granted hereunder will terminate, automatically and without notice, if you (or any of your subsidiaries, corporate affiliates or agents) initiate directly or indirectly, or take a direct financial interest in, any Patent Assertion:

(i) against Facebook or any of its subsidiaries or corporate affiliates,

(ii) against any party if such Patent Assertion arises in whole or in part from any software, technology, product or service of Facebook or any of its subsidiaries or corporate affiliates, or

(iii) against any party relating to the Software.

Notwithstanding the foregoing, if Facebook or any of its subsidiaries or corporate affiliates files a lawsuit alleging patent infringement against you in the first instance, and you respond by filing a patent infringement counterclaim in that lawsuit against that party that is unrelated to the Software, the license granted hereunder will not terminate under section (i) of this paragraph due to such counterclaim.

A “Patent Assertion” is any lawsuit or other action alleging direct, indirect, or contributory infringement or inducement to infringe any patent, including a cross-claim or counterclaim.

If you or your agent or exclusive licensee institute or order or agree to the institution of patent litigation or any other patent enforcement activity against any entity (including a cross-claim or counterclaim in a lawsuit) alleging that any of these implementations of WebM or any code incorporated within any of these implementations of WebM constitutes direct or contributory patent infringement, or inducement of patent infringement, then any patent rights granted to you under this License for these implementations of WebM shall terminate as of the date such litigation is filed.
